Question by designtime: Is a home equity loan a good idea for financing my new business?
I am a web developer and am thinking about quitting my day job and starting my own company. I?ve got some clients lined up already but need some financing to pay for startup costs such as equipment, supplies, and my office lease. Dipping into personal savings is not an option since there isn?t much there. :-) We?ve got a good amount of home equity. Would a home equity loan be my best option for getting the ball rolling on my business?

1 ? I?m set up as an LLC
2 ? Office ?lease? is month-to-month and I will take over my current employer?s payments of (a whopping) $ 150/month

presuming you cannot get a small business loan, it sounds OK to me. I would try and set up a corporation and get a loan to the corporation first, so your home can be protected.

Even with all the changes this new school year has brought such as the new bell schedules and new courses, there is still a consistency in Boulder High?s cheer teams.

But this year?s teams have also been subject to changes within now that many more students have been interested in joining, but the teams are determined to prevail.

?This is a year of firsts! It is a slight adjustment for everyone, but they are a wonderful group of kids, and we are thrilled to have them all,? coach Lindsey Edwards said.?

This year the varsity team is co-ed after many years of it consisting of only females. A junior varsity team has also been established.

All of these changes have been made in order to help assist in this year?s cheering events. Such events include performing at last Friday?s homecoming football game as well as other school sports events and cheer competitions.

This year?s competition team has been rehearsing endlessly in hopes of placing at the three competitions being held in Denver. Spirit for Change, UCA Mile High Regionals and Colorado State Championships are the main goals for the competition team.

For these events, the team has incorporated stunts, tumbling, cheering and dancing in a two-minute routine. To accomplish this, each team member is committed to the year-long sport.

?Our team practices through the summer, outside of practice and has a desire to build our program towards excellence,? Edwards said.

With the support of a dedicated staff that includes coaches Kristen Lewis, Marcia Thurston, Kira Thompson, Sara Garnica and choreographer Michael Gill, Boulder High students can expect to have fun and become spirited whenever the cheer teams step out on the field or mat this year.

Paris, one of the world's most-visited cities, is cracking down on short-term apartment rentals, dealing a blow to tourists looking for a bargain and entrepreneurial landlords hoping to recoup soaring property costs.

A rush of buying by foreigners looking to profit from the short-term rental market is one of several factors that have driven up Paris property prices at breakneck speed in recent years to stand as some of the costliest real estate anywhere.

The metropolis is now home to an estimated 20,000 fully furnished apartments rented out to tourists, students and business travelers in breach, according to city hall, of a decades-old and long-overlooked law.

Nicol's office has begun sending out letters warning owners that renting out residential apartments for less than a year at a time ? or nine months if the occupant is a student ? violates the law and could lead to prosecution.

Some 200 rental owners have already been tracked down with the help of neighbors upset at finding their bourgeois buildings housing more tourists than ordinary Parisians, said Nicol. An information campaign is to be launched in the weeks ahead.

The temptation to rent is strong, given the flood of visitors to Paris and the prices they are willing to pay.

A studio in the trendy Marais district can go for 700 euros ($958) a week, while a one-bedroom in picturesque Montmartre can fetch 200 euros a night, rates double or triple those of similar rentals on a traditional one-year-lease.

But the rates look like a bargain compared with hotel prices ? a fact that has not gone unnoticed by the industry's lobby.

"It's an absolutely unfair competition," said Bertrand Lecourt, president of Paris' hotel syndicate, who noted the myriad of taxes and regulations to which hotels are subject.

With visitors choosing rentals over hotels, the city is losing out on new tax revenue and new jobs, he added.

RED TAPE
Legally, owners wanting to offer short-term Paris rentals must ask the city to reclassify their property as a commercial site, a tricky request that obliges them to buy, in return, a commercial property nearby and devote it to residential housing.

Although the law can be interpreted in varying ways, and estate agents argue that most landlords are not running commercial businesses, violators can be fined up to 25,000 euros. Continued violation can mean further fines of up to 1,000 euros per square meter per day.

"It's an archaic law that the Town Hall has dug up due to pressure from the hotel sector," said a real estate agent in the Maris, asking not to be named. "I'd say 99.9 percent of short-term rentals are in breach of this law. We've had several people come in worried because they've received letters about it."

The warnings usually suffice to convince landlords to take their rentals off the market, according to the town hall. One court case in favour of the city was even confirmed in appeal.

Yet fighting the trend will be a challenge given many foreign owners rent out apartments as a full-time business.

While the French government has vowed to tackle tax shelters to slim down the public deficit, the fiscal advantages of furnished rentals remain untouched: owners can deduct from their revenue all maintenance expenses and even depreciate their property, thus avoiding taxes for several years.

"Short-term rentals are so attractive financially, fiscally and legally that if we don't act, we'll end up in a city where nobody will want to rent out apartments the usual way, and we'll only have tourists or people visiting for the week," Nicol said.

Lodgis, one of Paris' top short-term housing agencies, says the government is overlooking the benefits of a practice that suits students and professionals in town for only a few months.

Others say getting properties off the short-term rental market will make them available to full-time apartment-seekers who struggle to find affordable living space in a city where rental prices have shot up 20 percent in the past year.

"What we're defending is the possibility for small landlords to continue to use their property however they wish, and to rent it for the duration they wish," said Jean-Marc Agnes, chairman of APLM, a group of professionals operating furnished rentals. ($1 = 0.730 Euros)

Killing of Afghan leader endangers peace process (AP)

KABUL, Afghanistan ? The suicide bomber who killed the head of an Afghan peace council struggling to start meaningful negotiations with the Taliban delivered a potentially fatal blow to the efforts to find a political settlement in Afghanistan.

Afghan officials on Wednesday mourned the death of former President Berhanuddin Rabbani, who headed the High Peace Council. His assassin had claimed he was a Taliban leader seeking to reconcile with the government and had waited for days in Kabul on the pretext of wanting to talk to Rabbani about peace.

The assassination sapped hope for reconciling with the Taliban and raised fears about deteriorating security in Afghanistan just as foreign combat troops are starting to pull out. Some U.S. and Canadian troops have left in recent months and all foreign combat forces are to go home or move into support roles by the end of 2014 when Afghan forces are to be in charge of protecting and defending the nation.

Mohammad Ismail Qasemyar, the international relations adviser for the peace council, said the bomber, identified as Esmatullah, had approached several council officials, telling them that he was an important figure in the Taliban insurgency and would only speak directly with Rabbani.

"He wanted to talk about peace with Professor Rabbani," Qasemyar said.

The appeal was passed up to President Hamid Karzai, who called Rabbani and encouraged him to meet with Esmatullah, said Ahmad Wali Masood, the brother of Ahmed Shah Masood, the resistance leader who was killed by al-Qaida in 2001. It's unclear if Esmatullah was the attacker's real name.

The bomber stayed for days at a house used for guests of the peace council while waiting for Rabbani to return from a trip to Iran, Qasemyar said.

On Tuesday, the two met and the attacker went to shake hands with Rabbani at his home, bowing his head near the former president's chest and detonating a bomb hidden in his turban, Qasemyar said.

The U.S.-led coalition said another attacker was also involved, but that could not be confirmed by Afghan officials. The Interior Ministry said one person had been detained in connection with Rabbani's death ? the driver of the car that took the bomber to Rabbani's house. The driver was found with incriminating documents, said Atta Mohammad Noor, the governor of Balkh province. He did not reveal his source or provide further details.

Rabbani was seen as a unifying force who brought together different ethnic factions, many of whom disagreed about whether the government should even be seeking negotiations with the insurgency.

Rabbani had been a leader of the Northern Alliance resistance movement, and his involvement in the peace council silenced many in that group that didn't want to sit around a table with Taliban militants.

It was unclear who ? if anyone ? among Afghan powerbrokers might be able to fill that role now.

Waheed Muzhda, a Kabul-based analyst and former foreign ministry official under the Taliban regime that was toppled in late 2001, said it was hard to foresee a future for the year-old peace council.

"It is clear for Afghan people, and even for the international community, that the Taliban do not agree with what the Afghan government is suggesting," Muzhda said. "Nobody thinks that any positive development regarding the peace process through the High Peace Council is possible."

Sarajuddin Sirat, who is active in the council and headed Rabbani's political party in northern Baghlan province, said the former president's death will make it very difficult for peace negotiators to move safely around the country to talk with Taliban figures.

"How can we feel safe?" he asked. "Look what happened to Rabbani."

The street where Rabbani lived was under tight security Wednesday and those gathered outside feared another suicide attack because so many dignitaries were there paying their respects. Karzai cut short a trip to the U.S. on hearing of Rabbani's death and landed in Kabul late Wednesday. He visited those wounded in the attack in the hospital and paid his respects at Rabbani's house.

A black cloth, a symbol of mourning, was draped over a wall of Rabbani's house. Throughout the day, top clerics, tribal leaders, government officials, former jihadi commanders and members of Rabbani's party streamed in and out of the house as a loudspeaker broadcast readings of the Quran, the Muslim holy book.

The dignitaries included Vice President Gen. Mohammed Qasim Fahim; Abdullah Abdullah, a top opposition leader who ran against Karzai in the last election; Ismail Khan, a former warlord and current minister of water and power; and Atta Mohammed Noor, a powerful governor of Balkh province in the north. Local citizens denounced the Taliban, saying it was shameful for insurgents to kill an old man working for peace.

Neyamatullah Shahrani, a religious adviser to Karzai, said it will be difficult to replace Rabbani.

"He belonged to all Afghans. He was serving all the Afghan people. It's too early to say how it will affect the peace efforts, but it is very difficult to replace Rabbani. He had relations with all these tribes in Afghanistan."

The Pakistani government and leaders across the world condemned the killing. U.N. Secretary-General Ban Ki-moon called Afghan President Hamid Karzai as he rushed back to Kabul from the United States.

No one has claimed responsibility for the attack, but Gen. Mohammad Ayub Salangi, police chief in Kabul, said the Taliban were behind it.

When contacted by The Associated Press, Taliban spokesmen declined to discuss the killing and spokesman Zabiullah Mujahid said they were still investigating the killing.

"We are still gathering information on this. Right now our position is that we cannot say anything about this incident," Mujahid said in a statement posted Wednesday on a Taliban website.

In Washington, John Kerry, the chairman of the U.S. Senate Foreign Relations Committee, called Rabbani's assassination a "great setback" for the cause of peace and reconciliation in Afghanistan.

"Former President Rabbani was a historic figure who fought the Taliban in the 1990s and who continued to work for peace and stability as the head of the High Peace Council," Kerry said in a statement. "Afghanistan's enemies want to use his death along with other previous attacks to destabilize the region. We cannot let that happen. Too much is at stake for the people of Afghanistan and the country's future."

Afghans at Rabbani's home blamed the Haqqani network, a militant organization based in Pakistan and affiliated with the Taliban and al-Qaida that has conducted several attacks in the capital.

And some criticized the government for failing to provide security while standing just steps away from its top officials.

"They are continuing to kill our leaders," said Rashuddin, who was a close associate of Rabbani. "How can the bombers get into Kabul? How can they get into the house close to Rabbani? There should be tight security. The Americans are saying they are for peace and security while our leaders are dying in front of our eyes."

Rabbani, whose death came just days after insurgents attacked the U.S. Embassy in Kabul, was the latest high-ranking official close to Karzai to be killed by militants in recent months. Outnumbered on the battlefield, insurgents are conducting targeted attacks against officials aligned with the Afghan government and U.S.-led coalition, lowering hopes that Afghan forces can secure the country.

"Every day they are killing," said Mirza Mohammad, a 50-year-old former Afghan Army officer from Parwan province. "The killing of Rabbani has brought chaos to Afghanistan."

Mohammad, who was among those paying respects Wednesday at Rabbani's home in Kabul, called for a national uprising. "We will soon get revenge," he said. "Pakistan is behind this attack."

Meanwhile, in the Waghaz district of eastern Ghazni province, nine Afghan policemen were killed Tuesday evening while they were trying to defuse a roadside bomb, said Gen. Zirawer Zahid, provincial police chief.

And in the south, two NATO service members were killed in an insurgent attack, the alliance said in a statement Wednesday. NATO did not provide further details.

Including the latest deaths, at least 28 international troops have been killed so far this month in Afghanistan.

SANTA ANA, Calif. ? Ten Muslim students broke the law by shouting down a speech by an Israeli diplomat at the University of California, Irvine in a carefully drafted and executed plan that flouted repeated calls to behave by campus officials, a prosecutor said Monday.

Defense attorneys countered that students acted within the law when they stood up, one by one, and read from pre-scripted statements and never intended to halt Ambassador Michael Oren from speaking about U.S.-Israel relations.

Attorneys delivered closing arguments in the case that has stoked a spirited debate about free speech not just in the courtroom but in the affluent suburban community south of Los Angeles.

Many of the facts of the case are not in dispute: The students carefully planned their February 2010 protest and were escorted out by security officials.

Jurors in the case will be asked to decide whether students broke the law or were exercising a right to demonstrate freely.

The students face misdemeanor charges of conspiring to disrupt a meeting and disrupting a meeting. If convicted, they could face sentences ranging from probation with community service and fines to a year in jail.

The case also raised questions about prosecutorial discretion, with some members of the public calling the trial a waste of taxpayers' money. Other community members have said the defendants were being singled out because they are Muslim.

In his closing argument, prosecutor Dan Wagner told jurors the students acted as censors to block the free flow of ideas and infringed on the rights of 700 people who had gone to the campus that evening to hear Oren. He said emails among members of the Muslim Student Union showed students were aware they could be arrested before the protest.

"The right to free speech is not absolute," Wagner said before a packed courtroom of more than 180 people in Orange County, with more observers waiting outside. "If hecklers' vetoes were allowed, then nobody, nobody, none of us would have the right to free speech."

Defense attorney Reem Salahi said the students followed a series of protests at UC Irvine and elsewhere during which demonstrators shouted during lectures but weren't arrested or sanctioned.

In this case, UC Irvine officials expressed their displeasure with students' actions during the demonstration but didn't give hard rules on what was or wasn't permitted, she said.

"This is merely an admonition to be polite," she said. "But in America, we don't prosecute people for being impolite."

Salahi ? who represents two of the defendants ? said students never intended to stop Oren from speaking but instead wanted to express their views ? perhaps unpopular that evening ? on the Israeli government's actions in Gaza.

On Monday, Wagner and defense attorneys also showed dueling pie charts breaking down how much time the students demonstrated, how much time their supporters cheered, and how much time Oren spoke in an effort to prove whether the meeting suffered a significant disruption.

Near the end of her argument, Salahi said she wanted to share a personal story related to the trial but Wagner objected and Superior Court Judge Peter J. Wilson said she couldn't proceed.

She paused for a moment then told the jury, "I can't tell you the story ? I got shut down," to thunderous applause from the courtroom.

That brought an admonition Wilson, who said he would clear the courtroom if there was another outburst from the public.

Defense attorneys will continue their arguments Tuesday.

In 2010, the students were initially cited, released and disciplined at UC Irvine, which revoked the Muslim Student Union's charter for a quarter and placed it on two years of probation.

Nearly a year later, Orange County District Attorney Tony Rackauckas filed criminal charges against 11 students. The move prompted an outcry from the American Civil Liberties Union and a host of Jewish, Muslim and campus groups.

The filing also sparked a media frenzy, and Wilson eventually issued a gag order to prevent prosecutors and defense attorneys from arguing the case outside the courtroom. The charges against one defendant were later dropped.

Many of the students have since graduated from UC Irvine and the nearby University of California, Riverside.

On Monday, Wagner showed video clips of university officials pleading with demonstrators to behave and respect academic freedom. He also showed numerous emails among members of the Muslim Student Union planning the disruption and calculating who was willing to get arrested.

The correspondence, Wagner said, reveals students knew the risk of their actions and later tried to cover up that the organization was involved in the protest.

"It was always a plan to break the rules," he said.
