NASA Inquiry Halts Sale of $388,375 Apollo 13 Checklist, Other Space Artifacts (SPACE.com)

Heritage, we may have a problem.

That's more or less what NASA told Heritage Auctions of Dallas, Texas recently, in response to their record-setting, $388,375 sale of astronaut James Lovell's Apollo 13 flown checklist.

"NASA has made a claim against astronaut Jim Lovell, claiming that he does not have title to the checklist," Greg Rohan, Heritage's president, told collectSPACE.com in an e-mail.

But the space agency interprets its inquiry differently.

"We haven't filed a claim against [the checklist]," NASA spokesman Bob Jacobs told collectSPACE. "But what we have done is notify the auction house that we are seeking proof of ownership of the artifact."

"In conjunction with that, we've also notified the office of the Inspector General, which would be responsible for any investigation," Jacobs said.

Reached for this story, Lovell said it was inappropriate for him to comment at this time.

Checking the checklist

Heritage auctioned the Lunar Module Activation Checklist during its Nov. 30, 2011 space artifact sale. The 70-page, ring-bound book was used by Lovell during the 1970 moon mission to power up the lunar module Aquarius.

The spacecraft, which was intended to land on the moon, famously became the astronauts' lifeboat after a mid-flight explosion.

The checklist drew the most ever paid for a mission-used document due in part to it being featured ? in prop form ? during Ron Howard's 1995 movie "Apollo 13" starring Tom Hanks as Lovell. "If this paperwork isn't right, who knows where we will end up out here," Hanks, as Lovell, says in the film, referring to the checklist.

Heritage previously said that an "East Coast collector" had purchased the artifact, but with its ownership in question, it is now holding onto the checklist.

"Heritage transfers good title on all items it sells so pending the resolution of this matter between NASA and Mr. Lovell, we have suspended the sale and are holding the checklist in our vault," Rohan said.

Suspect souvenirs

The checklist was not the only artifact from the 200-item auction that NASA has asked for proof of ownership.

"NASA made a claim against a small number of items consigned by the astronauts including Mr. Lovell," Rohan said. "The sale of those items [like Lovell's checklist] has been suspended as Heritage awaits the outcome of the dispute between NASA and the astronauts."

According to Heritage, among the other items now on hold are a lunar module identification plate and a command module rotational hand controller from Apollo 9 astronaut Rusty Schweickart. ?[NASA's 17?Apollo?Moon Missions in?Pictures]

The plate, which was one of three flown aboard the 1969 Apollo 9 mission, had been listed as sold for $13,145. The joystick-like hand controller had been bid up to $22,705.

Heritage described both the ID plate and the controller as having been presented to Schweickart after the mission.

A fourth artifact, a glove used by the late Alan Shepard to train as commander of the Apollo 14 mission, came from the collection of a "NASA insider" who was given it by the astronaut. The glove had sold for $19,120.

In Lovell's case, he said that he found the checklist while cleaning out a bookshelf after he had donated many of his mission souvenirs to museums and given other items to his children.

"I decided to put this up for auction so that someone who is really interested in this piece of history can enjoy it," he told Reuters before the sale.

Rohan said Lovell believed the checklist was his to sell.

"Mr. Lovell, a national hero with an excellent reputation, warranted in writing to Heritage when he consigned the checklist, that he had clear title to the checklist and that it was his to sell," Rohan said.

Stirring up a fight, Obama names consumer watchdog (AP)

SHAKER HEIGHTS, Ohio ? Defying Republican lawmakers, President Barack Obama on Wednesday barreled by the Senate and installed a national consumer watchdog on his own, provoking GOP threats of a constitutional showdown in the courts. Setting a fierce tone in the election-year fight for middle-class voters, Obama said: "I refuse to take `no' for an answer."

Obama named Richard Cordray, a respected former attorney general of Ohio, to be the first director of the Consumer Financial Protection Bureau, after giving up on hopes for a confirmation vote in the Senate. The appointment means the agency is able to oversee a vast swath of lending companies and others accused at times of preying on consumers with shady practices.

In political terms, Obama's move was unapologetically brazen, the equivalent of a haymaker at Republicans in the Senate who had blocked his nominee. Acting right after Tuesday's presidential caucuses in Iowa, which showered attention on his opponents, Obama sought to make a splash as the one fighting for the rights of the little guy.

Presidents of both parties long have gotten around a stalled confirmation by naming a nominee to a job when the Senate is on a break through a process known as a recess appointment.

But Obama went further by squeezing in his appointment during a break between rapid Senate sessions this week, an unusual move that the GOP called an arrogant power grab.

The White House said what the Senate was doing ? gaveling in and out of session every few days solely to avoid being in recess ? was a sham. Obama's aides said the president would not be stopped by a legislative gimmick, even though it was Senate Democrats who began the practice to halt President George W. Bush's appointments.

"When Congress refuses to act, and as a result hurts our economy and puts people at risk, I have an obligation as president to do what I can without them," Obama said from Ohio, a state vital to Obama's re-election bid.

Consumer groups hailed Obama's decision; the U.S. Chamber of Commerce balked and warned it was so legally shaky that consumer bureau's work may be compromised.

The response from Republicans was blistering.

The top Senate Republican, Minority Leader Mitch McConnell, said Obama had "arrogantly circumvented the American people" and endangered the nation's systems of checks and balances. Republican Sen. Orrin Hatch of Utah called it a "very grave decision by this heavy-handed, autocratic White House."

And House Speaker John Boehner, R-Ohio, said: "It's clear the president would rather trample our system of separation of powers than work with Republicans to move the country forward. This action goes beyond the president's authority, and I expect the courts will find the appointment to be illegitimate."

Mitt Romney, a leading Republican presidential candidate, accused Obama of displaying "Chicago-style politics at its worst."

It was not immediately clear who might file a suit on the matter. Most likely, a private party regulated by the consumer agency would have the legal standing.

More than a standoff over one significant appointment, the fight speaks to the heart of a presidential campaign under way.

Obama is presiding over a troubled but improving economy. To try to win over voters, he is employing two strategies: in-your-face politics against a Congress held in low public regard, and a campaign pitch that he would represent the crunched middle class better than any of the Republicans he would face.

The Cordray appointment fits both.

Only with a director in place can the consumer bureau keep "dishonest" mortgage companies, payday lenders, debt collectors and others from harming consumers, Obama said. Speaking from a high school in the Cleveland suburb of Shaker Heights, Obama said Republicans were only blocking Cordray because they wanted to water down consumer protections.

Republican senators have called the consumer bureau too powerful and unaccountable, and held off on Cordray's bid as a means to get changes.

Cordray essentially starts right away, although his nomination will become official later in the week, the White House said. He is expected to serve until at least the end of 2013, which is the end of the Senate's next session.

In plowing ahead, the White House had to contend with some uncomfortable history.

Just last year, a lawyer from Obama's Justice Department said the office's view was that recess appointments could only come during legislative breaks of more than three days. That doesn't match up with what Obama did with Cordray, since the Senate was technically just in session on Tuesday.

The Senate's top Democrat, Harry Reid of Nevada, said in 2007 he would keep the Senate in "pro forma" sessions to block Bush from making an end run around the Senate and the Constitution with controversial nominations. That's exactly what Obama's White House now calls a gimmick. Yet on Wednesday, Reid came out in support of what Obama did.

As a senator in 2005, Obama opposed the recess nomination of John Bolton to be the U.S. ambassador to the United Nations, saying at the time that a representative who couldn't get through a Senate confirmation would be "damaged goods" with less credibility. Obama spokesman Jay Carney said Obama was just talking about the merits of the Bolton pick.

Obama certainly hasn't opposed recess appointments as president.

He had made 28 recess appointments before Wednesday, then named Cordray and three members to the National Labor Relations Board.

Bush made more than 170 such appointments when the Senate was away.

At the heart of the conflict this time is the arcane matter of what, exactly, constitutes a congressional recess.

White House lawyers ultimately determined that, for all practical purposes, the Senate is in the midst of about a monthlong break and Obama can move ahead as he pleases.

Eldar Murtazin gives RIM six months to win back customers, says Nokia is selling its soul to Microsoft

Murtazin is a guy well known for scoring handsets way ahead of even their debut showing. He also has an uncanny knack of knowing exactly what mobile companies are plotting -- sometimes. He's a guy worth listening to, especially for his often outspoken views on company failings. In his latest (lengthy) editorial, Eldar Murtazin takes umbrage with two companies that have weathered a tricky 2011; RIM and Nokia. He reckons that the BlackBerry makers have around six to eight months to convince people and the markets that there's still a future -- a worrying deadline given that we're not expecting to see its OS successor until the second half of 2012. Regardless of when these long-awaited QNX handsets do appear, Murtazin maintains that even if they arrived with the kind of OS that dreams are made of, they are unlikely to recover the ground lost in recent years -- especially on corporate handsets.

However, he saves most of his ire for the Nokia-Microsoft partnership, claiming that Nokia executives have lost their ability to sensibly judge the state of the mobile world. With apparently the "most valued" engineers and developers leaving the good ship Nokia, the shuttering of Nokia's own Ovi sync services are apparently talismanic of a shift closer to Microsoft. Murtazin thinks that Nokia CEO Elop has only two aims while at the helm; to ruin the company's chances of recovering in the mobile market and increasing Microsoft's own share and influence in the same sphere. He also reckons a Microsoft buyout of Nokia is still plausible, and while we're sure you've been reading Eldar's missives with a hefty side of salt, it would make for an even more interesting 2012.

(AP) ? The White House their goal, Republican presidential hopefuls raced across Iowa on Monday in a final, full day of frenzied appeals for support in precinct caucuses that open the 2012 campaign. "It is the race you make it," an upset-minded Rick Santorum told voters soon to pick a winner.

In the race's final hours, former Massachusetts Gov. Mitt Romney predicted victory and former House Speaker Newt Gingrich all but forecast his own defeat.

From Sioux City in the western part of the state to Davenport in the east, the six presidential hopefuls hustled through 23 fast-paced campaign events combined. That and the $13 million or more already spent on television commercials was evidence enough of the outsized importance Iowa holds in the race to pick a Republican opponent for President Barack Obama next fall.

Romney had one eye on his GOP rivals and another on Obama as he argued he is in the best position of all to capture the White House. The president has been "a great divider, the great complainer, the great excuse giver, the great blamer," said the former Massachusetts governor, who is making his second try for the nomination and has been at or near the top of the Iowa polls since the campaign began.

Later, before a noisy crowd in Marion, he predicted his own victory in a state that humbled him four years ago. "We're going to win this thing with all of our passion and strength," he said.

Texas Rep. Ron Paul flew into the state accompanied by his son, Kentucky Sen. Rand Paul, and urged supporters to "send a message tomorrow night that echoes not just around Iowa but ... around the world." Many in the audience of about 300 chanted "end the Fed," a reference to the Texan's pledge to abolish the nation's central bank as a first step toward repairing the economy.

Most polls in recent days have put Romney and Paul atop the field in Iowa, with Santorum in third and gaining ground. More than a third of all potential caucus-goers say they could yet change their minds.

"Do not settle for less than what America needs to transform this country. Moderate candidates who try to appeal to moderates end up losing," Santorum, the former Pennsylvania senator, said in a slap at Romney.

After absorbing a pounding in television commercials from Romney's deep-pocketed allies, Gingrich said he was looking ahead to next week's primary in New Hampshire, and then to one in South Carolina on Jan. 21

"I don't think I'm going to win, I think when you look at the numbers that volume of negativity has done its damage," he said of the Iowa caucuses.

Romney is viewed as the overwhelming favorite in New Hampshire, although Santorum, Paul and Gingrich have all said they intend to campaign there.

South Carolina figures to be more wide-open, the first contest in the South, and in a deeply Republican state.

If others were thinking about conceding Iowa, they did not show it.

Texas Gov. Rick Perry took swipes at Romney, Santorum and Paul in an appearance in Sioux City. "If you have my back tomorrow at the caucuses, I'll have your back for the next four years in Washington, D.C," he said.

Minnesota Rep. Michele Bachmann unveiled the first television ad in months. It hailed her as Iowa-born and the only "consistent conservative fighter" in the race and concluded, "She'll never back down."

The commercial was the last in a race in which the candidates' own ads were sometimes overshadowed by the more negative ones run by super PACs, organizations established and funded by their allies.

Perry and a super PAC supporting him spent the most, $5.5 million, according to one tally of the ad spending.

But it was the combination of Romney ($1.3 million) and his super PAC ($2.7 million) that appeared to have the most noticeable impact on the race. That was particularly so in the final few weeks, when Gingrich surged to the front of the polls.

The former speaker soon found himself under relentless attack in ads by the Romney super PAC. At the same time, the former Massachusetts governor's campaign took the high road, airing positive ads designed to show him in a favorable light.

Short on funds, Gingrich was unable to respond in kind, declaring instead he would run only a positive campaign.

It wasn't much of a contest, and before long, he faded, while Paul and then Santorum rose.

In fact, Gingrich's emergence was only one in a series of twists that seemed to produce a new front-runner every few weeks.

Bachmann earned that distinction when she won a straw poll last summer in Ames, but she was bumped off stride when Perry entered the race. His boomlet lasted until his first few debate performances were judged lacking, and then it became Herman Cain's turn. The former business executive suspended his campaign after being accused of personal indiscretions, and Gingrich began gaining ground, then Paul.

Throughout it all, Romney remained steady, advantaged by his well-funded campaign, the super PAC that supports him and the missteps of his rivals.

Yet to the end, the polls suggested the former Massachusetts governor was having trouble persuading Iowa Republicans that he was conservative enough to warrant their support.

Somehow, even an intense post-Christmas push by the candidates through Iowa's cities, small towns and smaller towns left Iowa Republicans uncertain about which contender to back.

"I'm really still undecided," said Bill Brauer, of Polk City, as he listened to Santorum speak on the campaign's final day.

"I'm going to make up my mind tonight," he said.
