Apple wins one 3G patent dispute with Motorola in Germany

A judge in Germany has ruled that Apple does not infringe?one of Motorola?s claimed 3G ?standards essential? patents, dismissing the related patent infringement lawsuit. The win is an important one for Apple, which has argued that patents related to 3G networking standards should not be used to gain injunctions against competitors? products that use those standards.

At issue in the lawsuit was European patent EP1053613, ?Method and System for Generating a Complex Pseudonoise Sequence for Processing a Code Division Multiple Access Signal.? In particular, Motorola claimed that Apple must have violated the patent if it implemented 3G networking in any device as Motorola declared it essential to 3G networking standards.

Judge Andreas Voss of the Mannheim Regional Court ruled that Motorola presented no evidence that Apple?s actual implementation used the specific means of generating the pseudonoise sequence claimed in the patent. Merely arguing that the specification required generating the pseudonoise sequence was not sufficient to prove Apple infringed the patent, according to Voss.

While Apple was able to get favorable rulings in other EU courts over alleged infringement of 3G-related patents, which are encumbered by agreements to license those patents under fair, reasonable, and nondiscriminatory (FRAND) terms, the legal precedents in Germany concerning such FRAND-encumbered patents is a little more complex. A FRAND defense can only be used if a company has made an offer to license the patents in question on FRAND terms and posted a bond for expected future royalties. If a patent holder then refuses the offer and sues, the FRAND defense can be used.

Under this legal framework, Apple lost a ruling over another 3G-related patent to Motorola in December 2011. The resulting injunction forced Apple to remove iPhones and iPads from its German online store for a short period last week, though a temporary stay let Apple put the products back on sale pending the result of an appeal.

In order to gain some clarity and standardization on royalties and limits to the use of FRAND-encumbered 3G patents, Apple sent a letter to the European Telecommunications Standards Institute (ETSI), the group responsible for creating 3G standards, last November. In the letter, Apple asked that royalty rates be based on the number of patents a company owns with respect to the entire pool of patents involved in the standard. It also asked that the base for calculating the royalty be standardized on the basic hardware used to implement the standard, not on the full retail value of a device that has 3G networking capabilities. Finally, Apple asked that FRAND patents be barred from being used to gain injunctions against competitors.

Both Microsoft and Cisco made statements supporting Apple?s FRAND principles after the contents of the letter were made public this week. Google, for its part, merely agreed to maintain Motorola?s stance on its FRAND commitments, which it told a court could be used as ?lethal weapons? against competitors.

GOP report questions Guantanamo detainee releases (AP)

WASHINGTON ? Facing domestic political pressures, the Bush and Obama administrations released or transferred 600 terror suspects deemed an acceptable threat from the U.S. prison at Guantanamo Bay, Cuba, only to find that 27 percent re-engaged in terrorist or insurgent activities, according to a report by Republicans on the investigations panel of the House Armed Services Committee.

The report, a copy of which was obtained by The Associated Press, provides the GOP perspective on an issue that has divided Washington since the start of the Afghanistan war and the opening of the Navy prison for those captured. And it split the White House and Congress last year over how to write rules on handling detainees.

The report comes as Obama administration officials have acknowledged they are considering whether to release several Afghan Taliban prisoners from Guantanamo and send them to a third country as an incentive to bring the Taliban to peace talks. The step is certain to create an uproar on Capitol Hill, especially among Republicans. The 93-page study is likely to be part of the GOP effort to influence the ongoing debate.

In a rare break on a committee that typically is bipartisan on defense issues, Democrats dissented from the report despite efforts to reconcile their differences, with four members of the Oversight and Investigations Subcommittee calling the study incomplete and declining to sign it.

The report cites testimony before the committee last year that 27 percent of former detainees "were confirmed or suspected to have been re-engaged in terrorist or insurgent activities," up from 25 percent the previous year. Intelligence officials had indicated that the number would increase.

"The Bush and Obama administrations, reacting to domestic political pressures and a desire to earn goodwill abroad, sought to reduce the Guantanamo population by sending detainees elsewhere," the report said. "Both administrations faced the persistent challenge of ensuring that the potential threat posed by each detainee had been aptly assessed before transfer or release, and that the countries that received the detainees had the capacity and willingness to handle them in a way that sufficiently recognized the dangers involved.

"Despite earnest and well-meaning efforts by officials in both administrations, the re-engagement rate suggests failures in one or both aspects of the process," the report concluded.

The report recommended that the Defense Department, CIA and other intelligence agencies report to Congress on the factors that contribute to a former detainee's re-engaging in terrorist activities. The committee also is seeking reports on the effectiveness of agreements with other countries.

As of Jan. 1, 779 individuals have been held at Guantanamo, 600 have left the installation, eight died there and 171 remain, the report said, citing the Defense Department.

The report noted that former Defense Secretary Donald Rumsfeld held the view that the military should not be a jailer and there was a plan to get detainees out. President Barack Obama also had vowed to close Guantanamo, though he has met strong resistance in Congress.

Lawmakers repeatedly have added provisions to various bills blocking the government from transferring detainees from Guantanamo to the United States, or barring the construction of facilities domestically to house terror suspects.

Rep. Adam Smith of Washington state, the ranking Democrat on the committee, said the report failed to take into account "the national security gains of shutting down the facility at Guantanamo. That is a goal that the Bush administration sought to achieve, and it is rightly a goal of the Obama administration. I continue to believe that the detention facility at Guantanamo Bay, Cuba, is a black eye for our nation abroad, serving as a powerful recruiting tool for terrorists. We have the ability to close the facility, and we should be working towards that end."

In their dissent, Democrats said the report assessed a few cases, presenting "an unbalanced, one-sided view of the consequences of the current transfer policy." Democrats pointed out that terror suspects who had been held at Guantanamo had been successfully resettled in Albania, Bermuda and Palau, among several other countries, and at least 73 percent have not re-engaged in terrorist or insurgent activities.

During the Obama administration, Democrats said, 66 individuals have been transferred from Guantanamo, with only two confirmed as re-engaging. That amounts to about 3.3 percent.

Romney's bad day is Santorum's best in GOP race (AP)

WASHINGTON ? Republican Rick Santorum is looking to capitalize on a string of stunning victories that snapped his four-state losing streak and raised new questions about front-runner Mitt Romney's clout with conservatives.

Romney shrugged off his poor showing, but his losses Tuesday in Missouri, Minnesota and Colorado laid bare his stubborn weakness just when it looked as if his party was beginning to embrace him. Bringing up the rear of the Santorum surge: Newt Gingrich, the former House speaker who mostly skipped the contests and finished at or near the back of the pack in all three states.

Santorum cast the results as a victory for a purer form of conservatism than Romney has offered, heard more clearly by voters across the nation's midsection without a deafening TV air war that the former Massachusetts governor has dominated.

"Tonight, we had an opportunity to see what a campaign looks like when one candidate isn't outspent 5- or 10-to-1 by negative ads impugning their integrity and distorting their record. This is a more accurate representation, frankly, of what the fall race will look like," a jubilant Santorum told a cheering crowd in St. Charles, Mo.

But it was far from clear that the former Pennsylvania senator, who has a post office box for a campaign headquarters and relies on volunteers to handle scheduling, can quickly turn the momentum into the millions of campaign dollars he would need to overcome Romney. Still, he looked past the nomination fight.

"I don't stand here to be the conservative alternative to Mitt Romney, I stand here to be the conservative alternative to Barack Obama," Santorum said. On health care, cap and trade and the Wall Street bailout, he charged, "Mitt Romney has the same positions as Barack Obama."

In Denver, Romney congratulated his rival. The revived questions about Romney's appeal with conservatives at the party's core were even sharper in light of his aggressive push to court them in recent days. Santorum's shoestring candidacy thrived. And the GOP nomination fight many in the party hoped would resolve itself after Super Tuesday now threatened to rumble past March 6 ? while Obama watches from his presidential perch in the White House, and waits.

"This was a good night for Rick Santorum," Romney told supporters in Denver on Tuesday night. He offered a bit of forced optimism: "We'll keep on campaigning down the road, but I expect to become our nominee with your help."

Romney added, "When this primary season is over, we're going to stand united as a party behind our nominee to defeat Barack Obama."

He wasn't the only loser.

On the first day of multi-state voting, the trio of contests exposed a glaring deficiency for Gingrich.

The former House speaker lacked the resources and organization to compete just as he's trying to project strength heading into the Super Tuesday elections. He made only minimal efforts in the three states that voted and stayed out of sight as the results rolled in. Gingrich is focusing on Ohio, where early voting has begun in the March 6 primary.

Texas congressman Ron Paul, meanwhile, reveled in his second-place win in Minnesota and vowed to keep collecting delegates to take to the GOP's national convention this summer.

To be fair, Tuesday's contests will have little bearing on the race for delegates. Missouri's nonbinding primary in particular was little more than an extensive warm-up routine. The state will hold an official caucus in March.

But even symbolic victories can produce or slow down momentum.

Romney's camp began downplaying the results hours before the voting began. Rich Beeson, his political director, released a memo earlier in the day noting that even Sen. John McCain lost 19 states on the way to capturing the GOP presidential nomination in 2008. And Missouri Sen. Roy Blunt, the director of Romney's congressional endorsements, released a statement as the votes began showing his candidate had lost in Blunt's home state.

"I congratulate my friend Rick Santorum on his win tonight," Blunt said. "But the fact remains that this is a nonbinding primary, meaning Missouri's delegates are still very much up for grabs."

Following Maine's low-profile caucuses, which conclude Saturday, the candidates will have an extended lull. Beeson recently noted that momentum would be vital heading into the 17-day period without an election, something he likened to a grand canyon with no precedent in modern presidential politics.

"If you don't have momentum and resources coming into it, it's going to be hard to have momentum and resources coming out of it," Beeson said.

That was a week before he realized his boss would suddenly see his momentum disappear.

This year?s event includes six award categories:

  • Exceptional Small Business of the Year (10 or fewer employees)
  • Exceptional Small Business of the Year (11 to 25 employees)
  • Exceptional Small Business of the Year (26 to 50 employees)
  • Outstanding Non-Profit Business (50 or fewer employees)
  • Young Small Business Person of the Year (under age 40 as of March 29, 2012)
  • Lifetime Achievement Award (for any individual doing business in Maui County for more than 20 years)

Completed nomination packets which include the Nomination Form, Nomination Criteria Form, two typewritten letters of recommendation from other sources, and a 5?x7? photograph of the nominee must be received at the Maui County Business Resource Center in the Maui Mall on or before 12 Noon on Friday, March 16, 2012.

Nomination forms are available at the Maui County Business Resource Center at Maui Mall; the Maui Chamber of Commerce; and American Savings Bank, Bank of Hawaii, Central Pacific Bank, and First Hawaiian Bank branches.? The form is also available online at www.mauicounty.gov/mcbrc ?and www.mauichamber.com, as well as on the Maui County and Maui Chamber of Commerce Facebook pages.

All finalists and winners will be honored at an awards dinner on Thursday, March 29, 2012, at the Waikapu Ballroom of the King Kamehameha Golf Club where photographs with Mayor Arakawa will be taken and presented to all finalists.

Finalists also receive a certificate and the company or business person?s name listed in an announcement to the media.? Winners will receive a Mayor?s Small Business Award Winner decal, a certificate from Mayor Alan Arakawa and the Maui Chamber of Commerce, a commemorative plaque, and the company or businessperson?s name listed in press releases sent to the media.

?Small businesses are the true job generators and they risk a great deal to open their doors, create jobs, grow and stimulate our economy.? Maui County is fortunate to have many successful small businesses who are known for their entrepreneurial spirit, innovation, and ingenuity,? said Mayor Alan Arakawa, in a written statement.

It was under Mayor Arakawa?s last administration in 2004 that the Maui County Small Business Awards program was originally created.

?Maui?s small businesses are at the heart of our community and they have gone through a lot these past few years to still be standing.? We look forward giving them well deserved credit and honoring their tremendous accomplishments and investment in our community,? said Pamela Tumpap, Maui Chamber of Commerce president.

Lin shoots Knicks to NBA win over Nets

Little-used Jeremy Lin had career highs of 25 points, seven assists and five rebounds as the host New York Knicks turned boos into cheers with a much-needed 99-92 NBA victory over the New Jersey Nets on Saturday night.

It was an unimaginable performance from Lin, who received no college scholarship offers and was cut by Golden State and Houston prior to this season. The Knicks signed him only to fill their roster.

"I think New Jersey didn't have a scouting report on him," Knicks forward Amar'e Stoudemire said.

"It just hasn't really sunk in yet," said Lin.

Stoudemire and Tyson Chandler scored 17 points each for the Knicks (9-15), who had lost five of six, leading to speculation about coach Mike D'Antoni's job security.

Asked about playing Lin for 36 minutes in a pivotal game, D'Antoni joked, "I'm panicking."

After excruciating losses to Chicago and Boston the last two nights, the Knicks fell behind by 12 points late in the first quarter and were booed by the home crowd.

Matched up against Nets star Deron Williams, Lin had two three-point plays late in the third period, then sank two jumpers early in the fourth quarter to give the Knicks an 80-77 lead.

Lin had another three-point play and layup to extend the margin to 97-86 with 1:36 left. At the buzzer, he was mobbed by his team-mates.

"There have been really down times for me last year and this year but this was one of the highs," Lin said.

Williams had 21 points and 11 assists for the Nets (8-17), who have dropped four of five.

In San Antonio, France's Tony Parker erupted for 42 points as the Spurs knocked off the NBA-best Oklahoma City Thunder 107-96.

Parker also passed Avery Johnson as the franchise's all-time assists leader with 4,477 as the Spurs improved to a league-best 13-1 at home before leaving on a nine-game road trip.

Meanwhile, Cleveland's Australian-born point guard Kyrie Irving scored 20 points, including a layup with 15 seconds to go, as the Cavs defeated the defending champions Dallas 91-88.

Elsewhere, the Chicago Bulls routed the host Milwaukee Bucks, 113-90; the Utah Jazz surged past the visiting Los Angeles Lakers, 96-87; the Orlando Magic edged the host Indiana Pacers, 85-81; the visiting Los Angeles Clippers crushed the Washington Wizards, 107-81; and the Philadelphia 76ers notched a 98-87 road win over the Atlanta Hawks.

Also, the Minnesota Timberwolves got past the visiting Houston Rockets, 100-91; the host Portland Trail Blazers pounded the Denver Nuggets, 117-97; the host Detroit Pistons held off the New Orleans Hornets, 89-87; the Phoenix Suns trimmed the visiting Charlotte Bobcats, 95-89; and the host Sacramento Kings edged the Golden State Warriors in overtime, 114-106.
