Judge orders trial in Wisconsin starved-teen case

MADISON, Wis. (AP) ? A 15-year-old girl who wasted away to 68 pounds lost the weight because of years of chronic starvation, not because of an eating disorder, a doctor testified Friday in a preliminary hearing for the parents accused of denying the girl food.

Dr. Barbara Knox, a director of the University of Wisconsin-Madison Children's Hospital, said the girl weighed a healthy 82 pounds as a 9-year-old, but wasted away to a dangerously underweight 68 pounds by February.

"Children are growing into little adults," Knox testified, "so we expect them to gain weight, not lose it."

She said she found no evidence of anorexia, bulimia or any other eating disorder in the Madison teen. She reiterated her diagnosis that the girl suffered "serial child torture" with prolonged starvation.

The girl's father and stepmother are charged with child abuse, child neglect and reckless endangerment. In a separate case, the girl's 18-year-old stepbrother is charged with forcing her to perform oral sex.

The Associated Press typically does not name the alleged victims of sexual assault, and it is not naming the defendants in order to protect the girl's identity.

Knox examined the girl Feb. 10, four days after she was hospitalized after running away from home wearing in thin pajamas. The 15-year-old had the weight of an average 9?-year-old and the height of an average 11?-year-old, the doctor said.

"If you line up 100 children (the girl's) age, she would weigh less than the skinniest child," Knox said.

In a videotaped interview released this week, the girl softly tells a police detective she was largely confined to her parents' basement. She says most of the food she ate was scraps she found on the floor or in the garbage, and that she was forced to bathe in a basement sink and relieve herself in boxes or containers.

The girl says she tried to leave home several times, but her family always found her and brought her back.

"I've just had it," she says at one point, breaking into tears. "I just don't even want to go back there."

Defense attorney William Hayes, who represents the 40-year-old father, cross-examined Knox. His questions seemed to suggest he was skeptical of the girl's mental health and the truthfulness of her allegations.

He asked whether Knox's diagnosis would be affected if the doctor found out the girl had self-mutilation tendencies or that she suffered head trauma while living with her biological mother. He also referred to a clinical psychologist's report that apparently said the girl created fantasies to compensate for the rage she felt for being abandoned by her mother.

Knox said she'd be happy to review any reports that provided more information.

Later, Hayes said the father suspected the girl may be anorexic. Knox said nothing in her diagnosis supported that.

She said the girl's behavior in the hospital was consistent with that of a persistently starved person. The girl ordered as many items from the menu as she could, then hoarded the food and tucked some away for later, Knox testified.

Judge Amy Smith found probable cause to advance to trial. An arraignment date hasn't been set.

Departing Goldman banker slams "rip-off" culture

LONDON/NEW YORK (Reuters) - Goldman Sachs faced an unprecedented assault from one of its own on Wednesday after a banker published a withering resignation letter in the New York Times, calling the Wall Street titan a "toxic" place where managing directors referred to their own clients as "muppets."

It was the latest blow for the investment bank. The company -- dubbed a "great vampire squid" in a 2009 article in Rolling Stone magazine -- has been embroiled in the biggest-ever insider trading scandal on Wall Street. And just weeks ago, a top judge criticized Goldman for big conflicts of interest in an energy deal.

In an opinion column in Wednesday's Times, Greg Smith, who worked in equity derivatives, said Goldman had become "as toxic and destructive as I have ever seen it.

"It makes me ill how callously people talk about ripping their clients off. Over the last 12 months I have seen five different managing directors refer to their own clients as 'muppets,'" Smith said.

In the United States "muppet" brings to mind lovable puppets like Kermit the Frog, but in Britain, "muppet" is slang for a stupid person. (Goldman, as it happens, was at one time also the bank for the family of Muppets creator Jim Henson.)

Goldman Sachs issued a short statement in response:

"We disagree with the views expressed, which we don't think reflect the way we run our business.?In our view, we will only be successful if our clients are successful.?This fundamental truth lies at the heart of how we conduct ourselves."

In a memo to staff, Goldman Chief Executive Lloyd Blankfein and Chief Operating Officer Gary Cohn said Smith's views were in the minority among his 12,000 fellow vice presidents.

"And, what do our people think about how we interact with our clients??Across the firm at all levels, 89 percent of you said that the firm provides exceptional service to them," they said in the memo, a copy of which was reviewed by Reuters.

Congressman Barney Frank, an architect of the 2010 Dodd-Frank financial reform law, said Smith's piece would have "a big impact" on the banking industry's efforts to push back against financial reform.

"It puts the burden on Goldman Sachs and others to show us how what they do benefits the clients and therefore the broader economy," he told Reuters.

Goldman shares closed 3.3 percent lower, on a day when broader markets were up slightly. At least one bank wasted no time in trying to take advantage of the situation.

"In my experience ... client success and firm success can peacefully coexist; in fact thrive," Harris Private Bank Chief Investment Officer Jack Ablin said in an open letter.

"Having served clients for nearly 30 years I can tell you that the long-term success of any institution, whether in the financial field or not, depends on the long-term success and satisfaction of its clients," said Ablin, who oversees $60 billion of investments for individuals and families.

But the company, which sometimes lacks for defenders, garnered at least some public support in response to Smith.

"The many people we have dealt with there have all been exceptionally talented and high-grade, and never once have we had a negative experience in which we felt that they took advantage of us or didn't do what they said they would do," well-known fund manager Whitney Tilson said in a note.

FRIENDLY AND GENUINE?

Smith, who did not return voice mails on his cellphone, carried the title of executive director, but it was not nearly as illustrious as it might sound. Goldman's roughly 12,000 vice presidents and executive directors compare with 450 managing directors -- the next rung up in the Goldman hierarchy and a job classification that Smith didn't achieve. Overall, the company has about 33,000 employees, meaning that 36 percent of Goldman's workforce carried a title similar to Smith's.

South African David Berman, founder of hedge fund Durban Capital and friends with Smith, called him "a very understated, humble type of guy who would tell the truth as truth is important to him.

"But he never struck me as the Goldman-type as he isn't aggressive nor (the) salesman type one expects," Berman said, adding, "I am convinced this is for real with no selfish intent here."

According to the British Financial Services Authority's register, Smith joined Goldman's UK unit a year ago.

Johannesburg-born Smith attended universities in his home country and in the United States, where he received a degree in economics from Stanford University in 2001. He also interviewed to be a Rhodes Scholar in South Africa in 2002.

While at student at Stanford he had a summer internship at Paine Webber in 1999 and a summer internship at Goldman in 2000. Upon graduating from Stanford in 2001, he landed at Goldman.

Internally, Smith's op-ed piece was not necessarily well received. A trader, who knew Smith in passing, said the company is telling staff that Smith is a disgruntled employee who is leaving because he didn't make managing director.

This trader, who did not want to be named, says former Goldman colleagues are saying that Smith "wasn't very commercial," which means he wasn't producing the kind of sales the company wanted.

PAST MEDIA STORMS

Goldman Sachs -- fourth among investment banks last year based on fee-income rankings compiled by Thomson Reuters and Freeman Consulting -- has a history of tension with client interests, experts say.

"Greg Smith refers to the last 12 years, but in fact Goldman has been doing this kind of thing since going back to the Great Depression," author William Cohan told Reuters Insider.

"It's not just the last 12 years; unfortunately it's part of the firm's DNA," said Cohan, author of the Goldman profile "Money and Power" and a former Wall Street banker himself.

In recent years the company has faced other high-profile incidents damaging to its image after the near-collapse of the global banking system in 2008.

Earlier this month it was accused of a major conflict of interest for advising El Paso Corp on its sale to Kinder Morgan, while being a significant shareholder in Kinder.

A lawyer representing an Australian fund in a lawsuit against Goldman over mortgage-backed securities, filed in New York last year and alleging fraud and breach of contract, said he may seek Smith's deposition to help bolster his case.

"Part of Goldman's defense is everybody is sophisticated and everybody knew as much as we knew did," the lawyer, Eric Lewis, said. "But if you're calling your clients muppets -- most muppets don't have the cranial capacity of Goldman."

Paul Volcker, a former Federal Reserve chairman, called the Smith piece a "reflection of the change in market mentality over the last 15, over the last 20 years" at an economics summit?in Washington hosted by the Atlantic magazine.

TWITTER IGNITES

Unsurprisingly, Smith's resignation letter captured the imagination of Twitter users. "Greg Smith" was a worldwide trending topic early Wednesday, meaning it had suddenly spiked in interest, while both that and "Goldman Sachs" were trending in the United States.

Many of the commentators expressed surprise about the allegations in the piece, while others called for Smith to shed light on why he left the bank, or pointed out that he seemed to have been employed in a comparatively junior role.

As happens on the Internet in cases like this, near-instant parodies of Smith's letter cropped up. The most popular by far had Darth Vader of "Star Wars" fame resigning from the Empire via a letter similar to Smith's.

"To put the problem in the simplest terms, throttling people with your mind continues to be sidelined in the way the firm operates and thinks about making people dead," the film franchise's dark lord wrote.

(AP) ? Welcome to the Caribbean, Republicans.

Puerto Rico doesn't get full voting privileges in Congress. It doesn't vote for the president in the general election. And it has been fighting for decades not just over its status as a U.S. territory but to make its voice heard on issues of national importance.

Now, islanders are getting their chance ? for one day at least.

A series of state-by-state Republican presidential contests on the mainland have failed to provide clarity to the muddy GOP field. So the race has turned to Puerto Rico. And on Sunday, Puerto Ricans will weigh in on who the GOP should pick to challenge President Barack Obama in the fall.

"We can do exceptionally well here in Puerto Rico, but we're going to need your help and support," Rick Santorum, Republican front-runner Mitt Romney's chief challenger, pleaded Wednesday at a town hall-style event in San Juan's financial district.

The Republican presidential primary has turned into a slog, with no end in sight anytime soon. Romney leads in the hunt for delegates to the national nominating convention and Santorum is looking to prevent him from getting the 1,144 needed to secure the party nod.

On Sunday, 20 delegates are at stake in Puerto Rico's GOP primary, more than those that were up for grabs in the first-in-the-nation New Hampshire primary in January. Puerto Rico's delegates will be split among candidates unless someone wins 50 percent of the vote, which is unlikely in a multi-candidate field.

The Caribbean island of 3.7 million people is part of the United States. Even though Puerto Ricans are U.S. citizens, they pay no federal taxes and cannot vote in presidential elections. Its political parties are largely built around disagreements over its political status. The fight over whether it should push for statehood or independence has been waged since 1964, and it's likely to shape the GOP primary race on the island. The economy too is certain to be an issue given Puerto Rico's sky-high 15.1 percent unemployment rate.

Santorum, the former Pennsylvania senator, arrived in Puerto Rico on an early morning flight from Louisiana, riding high on momentum from winning the Alabama and Mississippi primaries a day earlier.

"If we keep winning races, eventually people are going to figure out that Gov. Romney is not going to be the nominee," Santorum told a sun-drenched group of reporters outside the governor's mansion.

Santorum met privately with Puerto Rican Gov. Luis Fortuno ? he is a rising star in Republican politics who supports Romney ? for about half an hour early in the day.

Romney, the ex-governor of Massachusetts, is set to arrive Friday.

Puerto Rico was last in the national political spotlight four years ago, in June 2008, during the epic Democratic delegate battle between Hillary Rodham Clinton and Barack Obama. Clinton, who was a New York senator at the time with a huge crop of Puerto Rican constituents, campaigned hard on the island and won it 68 percent to 32 percent. At the time, Obama refused to take a position on the island's status. As president, Obama promised to "enable the question of Puerto Rico's status to be resolved" in his first term. But the administration was silent when the House weighed in on a bill in 2010 about the island's fate.

Four years after the Clinton-Obama clash, the struggle over statehood could end up helping Romney.

It divides politics on the island as much as the traditional Republican-Democratic split, and the establishment forces that will help get people to the polls prefer Romney's position on the issue. One aspect of the statehood fight is whether English should be made the official language in the former Spanish colony.

Fortuno, for one, hails from the New Progressive Party, which supports making Puerto Rico the 51st state. He has pushed for a referendum on the question, and on Nov. 6 voters will choose whether they want change the status quo and become a state instead of remaining a U.S. commonwealth. Congress has the ultimate say.

The two GOP candidates' approaches to where to go after Puerto Ricans vote have pushed Fortuno and others like him toward Romney. Fortuno spokesman Edward Zayas said Fortuno endorsed Romney early in the GOP nomination fight in large part because of the statehood question.

"I expect the people of Puerto Rico will decide that they want to become a state," Romney said at a forum in Miami last fall. "If that vote comes out in favor of statehood ... we will go through the process in Washington to provide statehood to Puerto Rico."

Santorum has hedged more, saying that while he would help Puerto Rico become a state, its people would have to make a "decisive decision" to do so. He said Wednesday that a simple majority of Puerto Ricans ? "50 percent plus one," as Santorum put it ? wouldn't be enough to show that islanders really want statehood.

And Santorum went further in an interview with local newspaper El Vocero, saying he doesn't think Puerto Rico should become a state unless it adopts English as its main language. Spanish has been the language of Puerto Rico since Christopher Columbus claimed the island for Spain in 1493. The Puerto Rican government does its business largely in Spanish, and many of its residents think cultural issues like language should be dictated by the states, not the federal government.

Beyond statehood, the race in Puerto Rico also could offer an opportunity for Republicans to appeal to Hispanic voters ahead of the general election. Obama has a significant edge among Hispanics, the nation's fastest-growing minority group, at a time when GOP candidates have been taking a hard line against illegal immigration.

On Wednesday, Santorum was pressed about his decision to support President Bill Clinton's promotion of Sonia Sotomayor to a U.S. district court judgeship, a position that eventually allowed her to become a member of the Supreme Court. Sotomayor is of Puerto Rican descent.

Romney has criticized Santorum for backing Sotomayor in the 1990s. But Santorum is defending his decision to vote for her two decades ago, saying the Senate should allow "great deference to the president" in selecting lower court nominees and said he would expect that if he were president.

"There's a different standard" for Supreme Court nominees, Santorum said.

For all its quirks, Puerto Rico's sudden prominence in the GOP primary contest isn't as unlikely as it may seem.

Some Republican operatives have long viewed the island as a significant primary battleground. There's also a potential financial benefit. Candidates often leverage local connections to reach deep-pocketed donors in Puerto Rican communities in Florida and New York.

Unsurprisingly, the Retina-ready apps are already flowing in. When I asked Apple for a list of third-party Retina-ready apps (all of Apple's apps are already upgraded) a few days ago for my iPad review, I was told that there would be a list ready to go for the actual launch on Friday. Sure enough, today Apple came back with an early list of apps. And they've pushed a new section of the App Store devoted to the new Retina apps. But I've also found several others that aren't on their list yet. Below, find a list of the new apps you'll want in order to take full advantage of the new screen.

Time to end pension tax relief - Director of Finance Online

George Osborne should curtail pension tax reliefs, despite the superannuation industry getting its retaliation in first. Any tax increase will cause squeals, but of all the chancellor?s options, taxing pensions is easiest and could even win votes.

The pension contribution-relief rules have meant that for each ?100 put into their funds ? corporate or private ? basic rate income-tax payers receive ?125 of investments. However, 40 per cent taxpayers have their payments enhanced by two-thirds and top-rate payers see their contributions? doubled.

Now that ?fairness? seems to be a measure of the fiscal system, it?s not hard to see how differential reliefs fail the test.

It is in the chancellor?s interest for people to pay into pensions. It makes them less of a burden on the state in old age and having a nest egg makes people feel wealthy, and more likely to consume, even if the pension pot doesn?t ultimately buy much income.

But the question for Osborne is whether workers would put less into their pensions if their tax relief was curbed. And the suspicion is that they would contribute anyway. The elasticity is almost certainly tight. People invest in pensions to look after their own future. If the contributions don?t go so far, they might well put in even more each year to achieve their objective.

And if some high-earners decide that relief at only the basic income-tax rate does not offset the loss of flexibility from locking savings into a pension plan, they will still probably save in an alternative vehicle.
So of all the options Osborne has for balancing his books, pensions look like a win-win ? less cost to the exchequer but a population that still aims for financial independence.

He could limit the amount that can be saved, but that has already come down from ?255,000 to ?50,000 for the 2011/12 tax year and going lower would hit middle-earners desperate to top up their paltry pots. He could tax the 25 per cent of pots that people can take as lump-sums when they retire ? but the public would notice and resent that, potentially losing the government parties votes.

So tempering relief looks the easy option. Limiting 50 per cent taxpayers to 40 per cent relief would be a start, but why stop there? Putting a limit of 30 per cent on all higher-rate taxpayers is simply a messy compromise. Reducing everyone to the same 20 per cent basic-income tax?rate for relief would save the Treasury a meaningful sum and show that we are all in it together.

The mass of basic-rate payers would not gain, but they might take sadistic satisfaction from the better-paid being worse off. And that can mean votes.

Not all Osborne?s decisions will be this easy and with such guaranteed success.
