FDA: Ind. farm tied to salmonella outbreak unclean

INDIANAPOLIS (AP) ? A federal inspector found two strains of salmonella and unclean conditions at an Indiana cantaloupe farm's fruit-packing plant during inspections prompted by a deadly outbreak linked to the farm's melons.

The Food and Drug Administration's report on the mid-August inspections at Chamberlain Farm Produce Inc. shows an inspector found improperly cleaned and apparently rusted and corroded equipment. The inspector also found what appeared to be algae growing in standing water beneath conveyer belts at the Owensville, Ind., plant, the report said.

Two strains of salmonella were found on cantaloupes in the farm's fields and on surfaces throughout the packing building located about 20 miles north of Evansville in southwestern Indiana, according to the report, which was posted Tuesday night on the FDA's website.

One salmonella strain was found on cantaloupes that had been processed in the building and boxed, according to the inspector, who wrote that she saw "indications of poor sanitary practices demonstrating contamination" in the fruit-packing building.

On Aug. 22, about a week after the FDA inspections, Chamberlain Farm Produce announced it had voluntarily recalled all of its cantaloupes due to concerns that some might be tainted with salmonella. Six days later, the FDA disclosed that genetic testing on salmonella collected at the farm matched the "DNA fingerprint" of the salmonella strain responsible for this summer's outbreak, making it a source for at least some of the bacteria.

FDA spokeswoman Carla Daniels said Wednesday that the agency is still investigating, but the Indiana farm is the only farm that's been linked to the salmonella outbreak to date.

The outbreak sickened at least 270 people in 26 states and killed three people in Kentucky, according to the FDA. The first cases were reported in July, and the FDA sent its last update on the outbreak on Sept. 13.

Gary Zhao, an attorney for Chamberlain Farm Produce, said in a statement Wednesday that the farm has been cooperating fully with FDA officials.

"While we acknowledge that the FDA report notes certain conditions allegedly observed at Chamberlain Farm, there is nothing in the report to indicate the conditions are a source of or contributed to any reported illnesses," Zhao said.

The Indiana farm last month pulled its watermelons from the market after salmonella was found on some of those fruits, but the farm's attorney has said that no illnesses had been linked to any of its watermelons.

One food safety advocate said she was disappointed but not surprised by the FDA's inspection report, which also found that farm managers were not monitoring the level of chlorine in a water-filled tank that's part of the cantaloupe processing line and had no documentation of the sanitizer's past use.

Barbara Kowalcyk, chief executive officer of the Center for Foodborne Illness Research & Prevention, said she and others pushing for tighter food safety regulations have seen many similar inspection reports over the years.

She said one of the most disconcerting findings in the report is that the packing building used sections of carpet in its cantaloupe processing line ? a material the FDA report noted is difficult to adequately clean.

Kowalcyk said many of the nation's fruit and produce growers are "well-meaning" but don't fully understand the safety implications of some of their processing techniques.

"From their perspective, using carpet is a good way to prevent bruising so that they don't have as many losses, financial losses. But carpet is just a huge sponge; it's a really good environment for trapping and growing bacteria," she said. "The reality is that these types of conditions are found at other establishments across the country."

Daniels noted the FDA is under no mandate to inspect farms such as Chamberlain Farm, unlike with food manufacturing plants. Instead, such farm inspections "are conducted on a case by case basis as the situation warrants," she said.

Florida man recovers from lightning strike in kite accident

A Florida man who was critically injured while flying a kite on a beach is recovering from his injuries.

Falk Weltzien, 39, was on Vilano Beach Monday with his 14-year-old son, Kai, when he was struck, the St. Augustine Record reported.

For a moment, Kai, thought he had lost his father.

"There's like a big white flash," Kai told ABC News. "I dropped my kite and then I looked over and I saw him laying on the ground."

Weltzien, of St. Augustine, had been hit by as much as one billion volts, enough electricity to light up a small town.

"When I looked at him his eyes were open and he was foaming from the mouth," Kai said. "Then I didn't look at him anymore because I was really scared."

An off-duty nurse who was nearby performed CPR.

In a 911 call for the incident, Kai could be heard telling the emergency operator that his father was turning blue.

"Make sure he's breathing," the dispatcher replied, advising that CPR be performed on the stricken man.

Weltzien was taken to Flagler Hospital. After a night in the intensive care unit, he survived with no major injuries.

"I'm feeling very thankful," Falk Weltzien said. "I know I could have been dead."

Solar cell consisting of a single molecule: Individual protein complex generates electric current

ScienceDaily (Oct. 2, 2012) ? An team of scientists, led by Joachim Reichert, Johannes Barth, and Alexander Holleitner (Technische Universitaet Muenchen, Clusters of Excellence MAP and NIM), and Itai Carmeli (Tel Aviv University) developed a method to measure photocurrents of a single functionalized photosynthetic protein system. The scientists could demonstrate that such a system can be integrated and selectively addressed in artificial photovoltaic device architectures while retaining their biomolecular functional properties.

The proteins represent light-driven, highly efficient single-molecule electron pumps that can act as current generators in nanoscale electric circuits.

The interdisciplinary team publishes the results in Nature Nanotechnology this week.

The scientist investigated the photosystem-I reaction center which is a chlorophyll protein complex located in membranes of chloroplasts from cyanobacteria. Plants, algae and bacteria use photosynthesis to convert solar energy into chemical energy. The initial stages of this process -- where light is absorbed and energy and electrons are transferred -- are mediated by photosynthetic proteins composed of chlorophyll and carotenoid complexes. Until now, none of the available methods were sensitive enough to measure photocurrents generated by a single protein. Photosystem-I exhibits outstanding optoelectronic properties found only in photosynthetic systems. The nanoscale dimension further makes the photosystem-I a promising unit for applications in molecular optoelectronics.

The first challenge the physicists had to master was the development of a method to electrically contact single molecules in strong optical fields. The central element of the realized nanodevice are photosynthetic proteins self-assembled and covalently bound to a gold electrode via cysteine mutation groups. The photocurrent was measured by means of a gold-covered glass tip employed in a scanning near-field optical microscopy set-up. The photosynthetic proteins are optically excited by a photon flux guided through the tetrahedral tip that at the same time provides the electrical contact. With this technique, the physicists were able to monitor the photocurrent generated in single protein units.

The research was supported by the German Research Foundation (DFG) via the SPP 1243 (grants HO 3324/2 and RE 2592/2), the Clusters of Excellence Munich-Centre for Advanced Photonics and Nanosystems Initiative Munich, as well as ERC Advanced Grant MolArt (no. 47299).

Republic Act No. 10175 or the Cybercrime Prevention Act of 2012 is a Philippine Republic Act signed by President Aquino on 12 September 2012. It aims to address legal issues concerning online interactions. Among the cybercrime offenses included in the bill are cybersquatting, cybersex, child pornography, identity theft, illegal access to data and libel, but the?new Act received mixed reactions upon its enactment especially on the grounds of freedom of expression, freedom of speech and data security.?Several petitions are currently submitted to the Supreme Court of the Philippines questioning the constitutionality of the Act.

Section 4 - Cyber Crime Offenses
(a) Offenses against the confidentiality, integrity and availability of computer data and systems

  • Illegal Access -?The access to the whole or any part of a computer system without right.
  • Illegal Interception -?The interception made by technical means without right of any non-public transmission of computer data to, from, or within a computer system including electromagnetic emissions from a computer system carrying such computer data.
  • Data Interference -?The intentional or reckless alteration, damaging, deletion or deterioration of computer data, electronic document, or electronic data message, without right, including the introduction or transmission of viruses.
  • System Interference -?The intentional alteration or reckless hindering or interference with the functioning of a computer or computer network by inputting, transmitting, damaging, deleting, deteriorating, altering or suppressing computer data or computer program, electronic document, or electronic data message, without right or authority, including the introduction or transmission of viruses.
  • Misuse of Devices -?The use, production, sale, procurement, importation, distribution, or otherwise making available, without right, of:
    • A device, including a computer program, designed or adapted primarily for the purpose of committing any of the offenses under this Act; or
    • A computer password, access code, or similar data by which the whole or any part of a computer system is capable of being accessed with intent that it be used for the purpose of committing any of the offenses under this Act.
  • Cyber-squatting -?The acquisition of a domain name over the internet in bad faith to profit, mislead, destroy reputation, and deprive others from registering the same, if such a domain name is:
    • Similar, identical, or confusingly similar to an existing trademark registered with the appropriate government agency at the time of the domain name registration:
    • Identical or in any way similar with the name of a person other than the registrant, in case of a personal name; and
    • Acquired without right or with intellectual property interests in it.

(b) Computer-related offenses

  • Computer-related Forgery-?The input, alteration, or deletion of any computer data without right resulting in inauthentic data with the intent that it be considered or acted upon for legal purposes as if it were authentic, regardless whether or not the data is directly readable and intelligible; or the act of knowingly using computer data which is the product of computer-related forgery as defined herein, for the purpose of perpetuating a fraudulent or dishonest design.
  • Computer-related Fraud -?The unauthorized input, alteration, or deletion of computer data or program or interference in the functioning of a computer system, causing damage thereby with fraudulent intent: Provided, That if no damage has yet been caused, the penalty imposable shall be one (1) degree lower.
  • Computer-related Identity Theft -?The intentional acquisition, use, misuse, transfer, possession, alteration or deletion of identifying information belonging to another, whether natural or juridical, without right: Provided, That if no damage has yet been caused, the penalty imposable shall be one (1) degree lower.

(c) Content-related offenses

  • Cybersex -?The willful engagement, maintenance, control, or operation, directly or indirectly, of any lascivious exhibition of sexual organs or sexual activity, with the aid of a computer system, for favor or consideration.
  • Child Pornography -?The unlawful or prohibited acts defined and punishable by Republic Act No. 9775 or the Anti-Child Pornography Act of 2009, committed through a computer system. The penalty to be imposed shall be (1) one degree higher than that provided for in Republic Act No. 9775.
  • Unsolicited Commercial Communications -?The transmission of commercial electronic communication with the use of computer system which seek to advertise, sell, or offer for sale products and services are prohibited unless:
    • There is prior affirmative consent from the recipient; or
    • The primary intent of the communication is for service and/or administrative announcements from the sender to its existing users, subscribers or customers; or
    • The following conditions are present:
    • The commercial electronic communication contains a simple, valid, and reliable way for the recipient to reject receipt of further commercial electronic messages (opt-out) from the same source;
    • The commercial electronic communication does not purposely disguise the source of the electronic message; and
    • The commercial electronic communication does not purposely include misleading information in any part of the message in order to induce the recipients to read the message.
  • Libel -?The unlawful or prohibited acts of libel as defined in Article 355 of the Revised Penal Code, as amended, committed through a computer system or any other similar means which may be devised in the future.

Section 5 - Other offenses under R.A. 10175

  • Aiding or Abetting in the Commission of Cybercrime - Any person who willfully abets or aids in the commission of any of the offenses enumerated in this Act shall be held liable.
  • Attempt in the Commission of Cybercrime - Any person who willfully attempts to commit any of the offenses enumerated in R.A. 10175 shall be held liable.

Penalties:?

  • For sections 4a and 4b, imprisonment of prision mayor or a fine of at least P200,000 or both.
  • For section 4a5, imprisonment of prision mayor or a fine of not more than P500,000 or both.
  • If section 4a are committed in critical infrastructure, penalty of reclusion temporal or a fine of at least P500,000 or both.
  • For section 4c1, imprisonment of prision mayor or a fine of at least P200,000 but not exceeding P1,000,000 or both.
  • For section 4c2, penalties as enumerated in RA 9775 or Anti-Child Pornography Act of 2009. 1 degree higher if committed in computer system.
  • For section 4c3, punishment of arresto mayor or a fine of at least P50,000 but not exceeding P250,000 or both
  • For section 5, punishment of 1 degree lower of the prescribed penalty for the offense or a fine of at least P100,000 but not exceeding P500,000 or both.
  • Corporate liability is equivalent to at least double the fines imposable in section 7 up to maximum of P10,000,000.

Enforcement and Implementation
The National Bureau of Investigation (NBI) and the Philippine National Police (PNP) shall be responsible for the efficient and effective law enforcement of the provisions of this Act. The NBI and the PNP shall organize a cybercrime unit or center manned by special investigators to exclusively handle cases involving violations of this Act. To ensure that the technical nature of cybercrime and its prevention is given focus and considering the procedures involved for international cooperation, law enforcement authorities specifically the computer or technology crime divisions or units responsible for the investigation of cybercrimes are required to submit timely and regular reports including pre-operation, post-operation and investigation results and such other documents as may be required to the Department of Justice (DOJ) for review and monitoring.

Ryan: More jobs yield more taxpayers

CLINTON, Iowa (AP) ? Republican vice presidential nominee Paul Ryan said Tuesday that he and running mate Mitt Romney would help more Americans find jobs so that they can pay taxes.

At a rally on the front lawn of a county courthouse, the Wisconsin Republican faced a question from a voter about why so many people don't pay federal income taxes. Romney recently was embarrassed when a secretly recorded video showed him telling donors that he would never win the votes of those Americans who don't pay federal income taxes. Democrats have been merciless in criticizing Romney for the remarks.

"We have 47 percent of the people in the United States pay no taxes, federal income taxes," the voter told Ryan. "Is there any way possible that this 47 percent can pay a nominal fee or something so that they feel that they have small ownership of the government and maybe they don't take all the handouts?"

Ryan said the answer was more jobs.

"I have an idea: Let's help them get jobs so they can get good paychecks and then they're good taxpayers," Ryan said, ignoring the fact that military members serving in war zones and seniors were among the millions who do not owe federal income taxes.

Ryan acknowledged, however, Romney's comments about the 47 percent muddled the political landscape.

"Sometimes the point doesn't get made the right way," Ryan said, but stood by the Romney campaign's standard rhetoric that the economy under President Barack Obama has been lousy and a GOP White House would fare better for workers.

Romney's campaign has suffered from the release of a hidden-camera video of Romney saying 47 percent of Americans see themselves as victims who depend on government help.

Last year, 46 percent of U.S. households paid no federal income tax, according to a study by the nonpartisan Tax Policy Center. Most do pay other federal taxes, including Medicare and Social Security withholding. And they're not all poor. Some middle-income and wealthy families escape income tax because of deductions, credits and investment tax preferences.

As Ryan set out on a bus tour of eastern Iowa, he tried to keep the campaign focused on Washington's spending and the Romney-Ryan ticket's plan to reduce it.

"We have a culture here in the Midwest that says you live within your means, you save, you don't waste," Ryan said. "You make sure your leave your children and your grandchildren better off."

He cautioned that deficit spending was leaving America weaker.

"We have a debt crisis on our horizon. We know this," he told the crowd on a chilly autumn morning. "Our debt is getting so big, so fast that it's going to surpass the debt levels that they have in Europe."

That, he said, threatens U.S. national security.

"Forty-eight percent of our debt is owned by foreign governments, China number one," Ryan said. "For every dollar that our government spends today, 36 cents of that is being borrowed, and about half of that is from countries like China. This means we have to rely on foreign governments to lend us their money to finance our government. We can't keep doing this. We have to put this to an end. We have to stop this because we lose our sovereignty and our independence and our ability to chart our own future."

(AP) ? The Boy Scouts of America plan to begin doing what critics argue they should have done decades ago ? bring suspected abusers named in the organization's so-called perversion files to the attention of police departments and sheriff's offices across the country.

The Scouts have, until now, argued they did all they could to prevent sex abuse within their ranks by spending a century tracking pedophiles and using those records to keep known sex offenders out of their organization. But a court-ordered release of the perversion files from 1965 to 1985, expected sometime in October, has prompted Scouts spokesman Deron Smith to say the organization will go back into the files and report any offenders who may have fallen through the cracks.

Smith said Mike Johnson, the group's youth protection director and a former police detective, will lead the review.

That could prompt a new round of criminal prosecutions for offenders who have so far escaped justice, said Clatsop County, Ore., District Attorney Josh Marquis. But investigations may require more than what most Scout files provide, including victims willing to cooperate.

"Let's even assume the suspect confessed," he said. "An uncorroborated confession is not sufficient for a conviction."

Many states have no statutes of limitations for children victimized when they were younger than 16, so even decades-old crimes could be fair game.

The Scouts began keeping the files shortly after their creation in 1910, when pedophilia was largely a crime dealt with privately ?not publicly. The organization argues that the files helped them track offenders and protect children. But some of the files released in 1991, detailing cases from 1971 to 1991, showed repeated instances of Scouts leaders failing to disclose sex abuse to authorities, even when they had a confession.

A lawsuit culminated in April 2010 with the jury ruling the BSA had failed to protect the plaintiff from a pedophile assistant Scoutmaster in the 1980s, even though that man had previously admitted molesting Scouts. The jury awarded $20 million to the plaintiff.

Files kept before 1971 remained secret, until a judge ruled ? and the Oregon Supreme Court agreed ? that they should be released. Attorneys are now redacting the addresses and other identifying material from the files, which stretch from 1965 to 1985.

The release means that alleged abusers, and the names of Scout leaders who failed to report them, will be made public soon in tens of thousands of pages of confidential documents __ one of the largest troves of the files the BSA has ever been forced to produce. A psychiatrist who reviewed the files, Dr. Jennifer Warren, found that police were involved in about two-thirds of the cases from 1965-1985.

Kelly Clark, a Portland attorney who won a landmark 2010 lawsuit against the Boy Scouts, says the documents show that even though the Scouts have been collecting the files nearly since the Boy Scouts' founding in 1910, the organization failed to use them to protect boys from pedophiles.

"What's significant is that the Boy Scouts could have these files for so long and not learn from them," Clark said.

Last week, the Scouts made public an internal report they compiled on the files by Warren, the psychiatrist who served as an expert witness for the Scouts in the 2010 Portland lawsuit. As part of the report, they emphasized the files' success in preventing pedophiles from entering Scouting ranks, but acknowledged the organization's failure to stop some abusers.

"In some instances we failed to defend Scouts from those who would do them harm," the Scouts said in a statement accompanying the report. "There have been instances where people misused their positions in Scouting to abuse children, and in certain cases, our response to these incidents and our efforts to protect youth were plainly insufficient, inappropriate, or wrong."

Warren's report found that, of 930 files created between January 1965 and June 1984, there were 1,622 victims. Of the total victims, at least 1,302 were involved in Scouting.

"My review of these files indicates that the reported rate of sexual abuse in Scouting has been very low," Warren wrote in the report.

Warren compared the rate of victimization in the Scouts ? about 1.4 to 2.1 youth per 100,000 ? to the nationally-reported incidence of child abuse by the U.S. Department of Health and Human Services, which found that in 1980, 70 per 100,000 children experience sexual exploitation each year.

Warren's analysis didn't account for the fact that files were destroyed for offenders who died or turned 75 years old, something she said didn't affect her overall conclusions.

Critics contend the organization's legal battles reflect a long-standing effort to protect the Boy Scouts' reputation, and to try to limit any lawsuits.

"It's a culture of denial and concealment," said Timothy Kosnoff, a Seattle attorney who in 2006 obtained documents on 5,200 alleged pedophiles who went into the files from 1949-2005.

Child killed in Kenya church grenade attack

NAIROBI (Reuters) - A nine-year-old boy was killed and three other children wounded when a hand grenade was thrown into a Sunday school session in a church in the Kenyan capital Nairobi, police and medical staff said.

Kenya has suffered a series of grenade attacks since it sent troops across the border into Somalia last October in pursuit of Islamist al Shabaab militants who it blamed for kidnapping its security personnel and Western tourists.

The attack on the church came days after Kenyan troops launched a surprise offensive on the southern Somali port of Kismayu, the last stronghold of the al Shabaab, forcing the rebels to flee.

Police said attackers threw the grenade into the Sunday school service in St. Polycarp's church on Nairobi's Juja Road.

The grenade exploded, spraying the children with shrapnel and fatally injuring the boy.

"We suspect this blast might have been carried out by sympathizers of al Shabaab," said deputy police spokesman Charles Owino.

"These are the kicks of a dying horse since, of late, Kenyan police have arrested several suspects in connection with grenades," he added.

Masked assailants launched simultaneous gun and grenade raids on two churches in the northern town of Garissa in July, killing at least 17 people.

Colombian president says to have prostate cancer surgery

BOGOTA (Reuters) - Colombian President Juan Manuel Santos said on Monday that he would undergo surgery for non-aggressive prostate cancer and that the tumor was caught "in time".

"It's a small tumor located on the prostate gland and it's a good prognosis, it's not aggressive," he said in an address to the nation.
